Abstract
Reviews the operation of agency in commercial transactions, including those conducted by third parties, and how mistakes are corrected through rectification. Discusses the types of agency concerned, the principles of attribution, and whether third party negotiators affect the principles of interpretation. Reviews the restrictive approach and how courts deal with negotiators in rectification claims, including unilateral and common mistake.
