Abstract

The universal nature of human rights was set out as for everyone without distinction in the Universal Declaration of Human Rights of 1948. However, this text does not define the role of culture or of cultural rights. Much of the recent debate has argued that, while cultural rights cannot simply be placed on a par with human rights, human rights such as dignity and justice need to be seen as driving forces behind decision‐making with regard to cultural heritage and its management. Rights‐based approaches—which we might argue are an extension of values‐based approaches in that they reflect the idea that some values are rights, and not simply interests or concerns—could be a very useful construct for promoting critical debate on the values of heritage and on the decisions taken regarding its use.
